Kleenway Services Inc., operating as KSI ("KSI," "we," "us," or "our"), respects your privacy and is committed to protecting the personal information of individuals who visit our website, contact us, use our services, conduct business with us, or apply to work with us.
KSI's head office is located in the Greater Toronto Area, Ontario, Canada, and we deliver facility services at client sites across multiple Canadian provinces and several U.S. states. Our administrative, dispatch and back-office functions are performed from our Ontario head office and support both our Canadian and U.S. operations. As a result, personal information we handle may originate in either country, may be stored or accessed in either country, and may be subject to the privacy laws of more than one jurisdiction.
This Privacy Policy explains the personal information we may collect, why we collect it, how we use and disclose it, where it may be stored or processed, how we protect it, and the rights and choices that may be available to you.
1. Scope of This Policy
This Privacy Policy applies to personal information relating to:
Visitors to ksintegrated.com;
Current, former and prospective clients and their representatives;
Vendors, subcontractors, suppliers and trade partners; and
Job applicants.
It applies to personal information handled in connection with our operations in Canada and the United States, regardless of the country in which you are located when you deal with us.
Our privacy practices are intended to comply with applicable privacy and data-protection requirements in the jurisdictions in which we operate, including, where applicable:
In Canada:
The federal Personal Information Protection and Electronic Documents Act ("PIPEDA");
Substantially similar provincial privacy legislation, including Alberta's Personal Information Protection Act, British Columbia's Personal Information Protection Act, and Quebec's Act respecting the protection of personal information in the private sector, as amended; and
Canada's Anti-Spam Legislation ("CASL") in relation to commercial electronic messages.
In the United States:
The California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), where applicable to KSI and the individual concerned;
Other U.S. state comprehensive consumer privacy laws, where applicable to KSI and the individual concerned; and
The federal CAN-SPAM Act and applicable state requirements in relation to commercial electronic messages.
Not all of these laws apply to KSI in all circumstances. Many U.S. state privacy laws apply only to organizations meeting specified revenue or volume thresholds, and most exclude information collected in a business-to-business or employment context. Where a law applies, KSI will give effect to the rights it provides. You are not required to identify the applicable law in order to make a request.
This Privacy Policy does not govern personal information relating to KSI employees in the context of their employment, which is addressed through KSI's internal employment privacy and information-management practices, except where applicable law extends specific rights to employees or job applicants, in which case the rights described in Section 11 apply.
2. Accountability
KSI is responsible for personal information under its control, including personal information transferred to a third party for processing on our behalf.
KSI has designated a Privacy Officer, based at our Ontario head office, who is responsible for overseeing compliance with this Privacy Policy and applicable privacy requirements in both our Canadian and U.S. operations.
The Privacy Officer is also the individual able to answer questions about the collection, use, disclosure and storage of personal information by service providers located outside Canada. Questions, concerns and privacy requests may be directed to our Privacy Officer using the contact information in Section 14.
3. Personal Information We Collect
The personal information we collect depends on the nature of your interaction with KSI.
3.1 Information You Provide to Us
We may collect information such as:
Name, employer or company name and job title;
Business email address, telephone number and mailing address;
Site or property address and access information required to coordinate or deliver services;
Information regarding facility-service requirements, including service type, building type, approximate square footage, scope, scheduling and current service arrangements;
Billing and account information;
Information contained in requests for proposal, requests for quotation, tender submissions and related procurement correspondence; and
Other information you voluntarily provide through a contact form, quote request, telephone call, email or other communication with KSI.
3.2 Information From Job Applicants
When you apply for employment with KSI, we may collect:
Your resume and cover letter;
Employment and education history;
Professional references;
Certifications, licences and qualifications;
Work authorization information; and
Information collected during interviews and, where applicable and with appropriate authorization or consent, reference or background checks.
KSI recruits in both Canada and the United States. Applications for U.S. positions may be reviewed and administered from our Ontario head office, and applications for Canadian positions may be processed using recruitment or applicant-tracking platforms hosted in the United States.
3.3 Information Collected Automatically
When you visit our website, we may automatically collect certain technical and usage information, including:
IP address and approximate location at the city or regional level;
Browser type, operating system and device information;
Pages viewed, time spent on pages, referring website and links clicked; and
Information collected through cookies and similar technologies, as described in Section 7.
Our website serves visitors in both Canada and the United States. Where general location is derived from your IP address, it may be used to understand website usage and, where relevant, to present appropriate privacy and cookie choices.
3.4 Information From Other Sources
We may also receive information from:
Business contacts who refer or introduce you to KSI;
Publicly issued tender and procurement documents; and
Business contact information that you or your organization has made publicly available for business purposes, where our use is consistent with the purpose for which the information was made available and applicable law.
KSI does not knowingly collect personal information from children through its website. Our website and services are directed primarily to businesses and adults.
4. Why We Collect and Use Personal Information
KSI collects, uses and discloses personal information for purposes that a reasonable person would consider appropriate in the circumstances and as permitted or required by applicable law.
These purposes may include:
Responding to inquiries, quote requests and procurement opportunities;
Assessing, pricing, scheduling and delivering facility services;
Coordinating site access, security requirements, safety requirements and on-site service delivery;
Administering client and vendor relationships;
Administering accounts, invoicing and payment;
Communicating regarding active service requests, including urgent or unscheduled work;
Sending information about KSI services and other commercial communications where permitted by law;
Operating, maintaining, securing and improving our website and technology systems;
Recruiting, evaluating and communicating with job applicants in Canada and the United States;
Meeting legal, regulatory, contractual, health and safety, insurance, audit and certification requirements in the jurisdictions in which we operate;
Supporting our quality, environmental and occupational health and safety management systems;
Detecting and preventing fraud, misuse or security incidents; and
Protecting KSI, our employees, clients, facilities, systems and other persons.
KSI does not use personal information for automated decision-making that produces legal or similarly significant effects concerning an individual.
We will not use personal information for a materially different purpose without obtaining any consent required by applicable law, unless the new use is otherwise permitted or required by law.
5. Consent
KSI collects, uses and discloses personal information with your consent, except where applicable law permits or requires us to do so without consent.
The appropriate form of consent will depend on the circumstances, including the sensitivity of the information and your reasonable expectations.
Express Consent. We may seek express consent where information is sensitive, where the purpose for collection or use would not reasonably be apparent, or where express consent is required by law.
Implied Consent. Where you voluntarily provide information to request a quote, obtain services, participate in a procurement process or discuss a commercial relationship, we may rely on implied consent where permitted by law to use that information for purposes reasonably connected with your request or relationship with KSI.
Withdrawing Consent. Where our processing is based on consent, you may withdraw that consent, subject to applicable legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect KSI's ability to provide certain services or respond to certain requests. To withdraw consent, contact our Privacy Officer using the information in Section 14.
U.S. privacy laws may provide additional opt-out rights. Where applicable, those rights are described in Sections 7, 8 and 11.
6. How We Share Personal Information
KSI does not sell personal information, and does not disclose personal information to third parties in exchange for monetary or other valuable consideration.
We may disclose personal information where reasonably necessary for the purposes described in this Privacy Policy, including to:
Service Providers. Third parties that provide services to KSI, such as website hosting, email and productivity systems, customer relationship management platforms, analytics, telecommunications, payment processing, software and IT support. KSI seeks to engage these providers under contractual, confidentiality and data-protection requirements appropriate to the circumstances, including, where required by applicable U.S. state privacy law, terms applicable to a "service provider," "processor" or "contractor."
Subcontractors and Trade Partners. Where subcontractors or specialized trades are engaged to perform authorized services, KSI may provide information reasonably necessary to coordinate and complete the work. KSI requires subcontractors and trade partners receiving personal information to protect that information in accordance with applicable contractual and legal requirements.
Within KSI. Personal information may be shared between our U.S. operations and our Ontario head office as reasonably necessary to price, schedule, deliver, invoice and support the services described in Section 4.
Professional Advisors. Lawyers, accountants, auditors, insurers and other professional advisors where reasonably necessary and subject to applicable confidentiality obligations.
Government, Regulatory and Legal Authorities. Where disclosure is required or permitted by law, regulation, court order or other valid legal process, or where reasonably necessary to protect legal rights or the safety of persons or property.
Business Transactions. In connection with a proposed or completed merger, acquisition, financing, reorganization, sale or other business transaction, subject to applicable legal requirements and appropriate protections.
KSI seeks to limit disclosure to the information reasonably necessary for the applicable purpose.
7. Cookies, Analytics and Advertising Technologies
Our website uses cookies and similar technologies to operate the website and may use them to understand website usage and support advertising or marketing activities.
Depending on the technologies deployed on the website, cookies may include:
Strictly necessary cookies, which are required for the website to function;
Performance and analytics cookies, which help us understand website traffic and usage patterns; and
Advertising or retargeting cookies, where used, which may allow KSI or third-party advertising platforms to measure advertising activity or display relevant KSI advertising on other websites or services.
KSI's website uses a cookie-consent mechanism under which Performance/Analytics and Advertising cookies are disabled by default. Visitors must affirmatively opt in before these categories of non-essential cookies are enabled. KSI applies this approach to visitors in Canada and the United States alike.
You may manage available cookie preferences through the website's cookie settings and may also control certain cookies through your browser settings. Disabling cookies may affect the operation or functionality of some parts of the website.
Certain U.S. privacy laws may characterize some uses of third-party advertising or retargeting technologies as a "sale," "sharing," or use for targeted or cross-context behavioural advertising, even where no money is exchanged.
Where KSI uses such technologies and applicable law provides an eligible individual with an opt-out right, the individual may exercise that right through the cookie-preference mechanism provided on the website or by contacting our Privacy Officer using the information in Section 14.
Certain U.S. privacy laws may also require covered businesses to recognize qualifying browser-based opt-out preference signals, such as Global Privacy Control. KSI will comply with applicable opt-out preference signal requirements where legally required. Our current website consent technology does not automatically process Global Privacy Control signals. Individuals may nevertheless submit an applicable opt-out request using the cookie-preference mechanism or by contacting our Privacy Officer.
KSI periodically reviews its website privacy controls and may update its consent-management technology as applicable legal requirements and our website practices evolve.
8. Marketing Communications
KSI does not currently operate a general email marketing program through its website.
If KSI sends commercial electronic messages or implements an email marketing program in the future, it will do so in accordance with applicable requirements, including CASL in Canada and the CAN-SPAM Act and applicable state requirements in the United States.
Where required by applicable law, KSI will obtain the necessary consent before sending commercial electronic messages unless an exemption applies.
Commercial electronic messages subject to applicable marketing requirements will identify KSI, provide required contact information and include an unsubscribe mechanism where required. Applicable unsubscribe requests will be processed within the period required by law.
Operational, transactional and service-related communications concerning requested services, existing commercial relationships, safety matters or similar business matters may not constitute marketing communications and may continue where permitted by applicable law.
9. Where Personal Information Is Stored and Processed
KSI is headquartered in Canada and operates in Canada and the United States. Personal information may be stored, accessed or processed in either country, and by service providers and technology platforms that may be located in Canada, the United States or, in limited circumstances, other jurisdictions.
Information transferred into Canada. If you are located in the United States, your personal information may be transferred to, stored in and accessed from our head office in Ontario, Canada, for the administrative, coordination and service-delivery purposes described in Section 4.
Information transferred into the United States. If you are located in Canada, personal information may be stored or processed in the United States by service providers that support functions including website hosting, email and productivity systems, customer relationship management, analytics, recruitment and IT support.
Where personal information is processed outside your province or country of residence, it may become subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement agencies, national-security authorities or other governmental authorities in accordance with applicable law.
KSI remains accountable for personal information transferred to a third party for processing. KSI takes reasonable steps to assess service providers, seeks to transfer only the information reasonably required for the applicable function, and uses contractual, organizational and other measures appropriate to the circumstances to protect personal information entrusted to them. Where applicable law requires an assessment before personal information is communicated outside a province or country, KSI will conduct that assessment.

10. Retention
KSI retains personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected and to meet applicable legal, regulatory, contractual, insurance, limitation-period, audit and certification requirements.
Retention periods vary according to the nature of the information and the purpose for which it is held.
As a general guide:
Website analytics information is retained according to the settings and retention periods configured within the applicable analytics platform;
Inquiry, proposal and quote records may be retained for the duration of the commercial relationship or opportunity and for a reasonable period afterward;
Client service, contractual and billing records are retained in accordance with applicable legal, tax, contractual and business requirements; and
Unsuccessful employment applications may be retained for a reasonable period for recruitment, record-keeping and future employment opportunities, subject to applicable law.
When personal information is no longer reasonably required, KSI will securely destroy, erase, anonymize or otherwise dispose of it in accordance with applicable requirements and our information-management practices.
11. Your Rights and Choices
Depending on where you reside and the privacy laws applicable to your information, you may have rights relating to your personal information.
Subject to applicable legal, contractual and other permitted exceptions, these may include the right to:
Request access to personal information KSI holds about you;
Request information about how your personal information has been used or disclosed;
Request correction of inaccurate or incomplete personal information;
Request deletion or erasure of personal information where such a right is provided by applicable law;
Withdraw consent where processing is based on consent; and
Opt out of marketing communications.
KSI may be required or permitted to retain certain information despite a deletion request, including information required for legal, contractual, tax, insurance, security, dispute-resolution or record-keeping purposes.
11.1 Additional Rights in Certain Canadian Provinces
Depending on the province in which you reside, additional rights may be available under applicable provincial privacy legislation, subject to applicable exceptions. These may include rights relating to access, correction, portability and information regarding the collection, use, disclosure or location of your personal information.
11.2 Additional Rights for California Residents
Where the CCPA applies to KSI and your personal information, California residents may have additional rights, subject to applicable exceptions, including rights to request access to, correction or deletion of qualifying personal information; obtain information regarding KSI's collection, use and disclosure of personal information; opt out of the sale or sharing of personal information where applicable; and exercise applicable privacy rights without unlawful discrimination.
KSI does not sell personal information. Where KSI uses advertising or retargeting technologies that constitute "selling" or "sharing" under applicable California law, eligible individuals may exercise applicable opt-out rights as described in Section 7.
Where the CCPA applies, it may extend rights to employees, job applicants and business contacts as well as consumers.
11.3 Additional Rights in Other U.S. States
Where another U.S. state comprehensive consumer privacy law applies to KSI and to you, additional rights may be available under that law.
Where required by applicable law, you may appeal a decision KSI makes in response to your request. If KSI declines a request, we will advise you of the reasons and, where required, how to submit an appeal. If an appeal is denied, we will provide any additional information required by applicable law regarding further complaint rights.
11.4 Authorized Agents
You may designate an authorized agent to submit a qualifying request on your behalf where permitted by applicable law. KSI may take reasonable steps to verify your identity, the validity of a request and the authority of an agent before fulfilling a request.
11.5 How to Make a Privacy Request
Privacy requests may be submitted to our Privacy Officer using the contact information in Section 14. You are not required to identify the law on which you rely; please tell us what you are requesting and the province or state in which you reside.
KSI may take reasonable steps to verify your identity before providing access to, correcting or deleting personal information.
We will respond to privacy requests within the time period required by applicable law. Where an extension is required and permitted, we will provide notice in accordance with applicable requirements.
12. Safeguards and Information Security
KSI maintains administrative, technical and physical safeguards appropriate to the nature and sensitivity of the personal information under our control. The same safeguards apply to personal information held in connection with our Canadian and U.S. operations.
These measures may include:
Access controls;
Confidentiality requirements;
Employee training and awareness;
Appropriate technology and system-security measures;
Secure hosting and information-management practices; and
Contractual protections with applicable service providers.
No method of electronic transmission, processing or storage can be guaranteed to be completely secure. Accordingly, while KSI takes reasonable measures to protect personal information, we cannot guarantee absolute security.
Where a privacy or security breach occurs, KSI will investigate and take appropriate action. Where notification or reporting is required by applicable law, KSI will notify affected individuals, regulators or other authorities as required.
13. Third-Party Websites and Services
Our website may contain links to websites, social-media platforms, job boards or other online services operated by third parties.
KSI does not control and is not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of third-party websites or services before providing personal information to them.
